This Privacy Policy describes Tried and Trend’sTM (hereinafter “Tried and Trend’s” or “the App”) policies and procedures on the collection, use and disclosure of the User’s (hereinafter “user,” “you” or “your”) information when using the App. This Privacy Policy also provides information on how you can exercise your legal rights to privacy by controlling your privacy settings.
For purposes of this Privacy Policy, references to “the App” refer to both the Tried and Trend app itself as well as the team of people creating, controlling, and maintaining the App and its evolving functions. References to “we” or “us” refer to the team of people creating, controlling, and maintaining the App and its evolving functions. References to “the Services” refer to the services the App expressly provides to users, namely cataloging users’ wardrobes and suggesting outfit combinations based on user preferences.
Tried and Trend’s ability to provide its service depends on your consent to the collection and the use of your information as described herein. Specifically, your consent to this Privacy Policy enables the App to utilize capabilities including but not limited to the following:
- Storing your Virtual Closet[1] so the App can repeatedly create new outfit combinations without requiring you to upload records of your entire wardrobe every time you open the App,
- Generating patterns of items that result in complete outfits that are appropriate in terms of your geographic location, season and weather patterns, personal style, and type of occasion;
- Formulating a predictive basis so the App can suggest outfit combinations tailored to your preferences and unique style; and
- Curating your ad experience to your preferences.
By using the App, you agree to the collection and use of your information in accordance with this Privacy Policy.

The App collects Personal Data, Usage Data, and Cookies.
Personal Data refers to any information related to an identified or identifiable natural person[2]. Personal Data, also called Personally Identifiable Information (“PII”) includes but is not limited to:
o Your name, physical address, email address, telephone number, geographic location, or any other contact information;
o Your uploaded photos, comments, reviews, and any other information you share with third parties on this App or across other websites; and
o Information about your mobile device or accessing system, your device’s unique Internet Protocol address (“IP address”), and other unique device identifiers and other diagnostic data.
For purposes of this Privacy Policy, “Personal Data” and “Personal Information” will be used interchangeably, both falling under the definition of Personal Data provided above.
Your Personal Data is collected in a few different ways:
(i) Some pieces of your Personal Data, such as the identifying traits of your device, are automatically collected by the App without any affirmative act on your part beyond consenting to this Privacy Policy and using the App;
(ii) You affirmatively add and save some forms of Personal Data into the App, such as your contact information, location, photographs, and other pieces of information related to you as an individual. We may access anything that you affirmatively upload and store on the App; and
(iii) If you provide your email account(s) to enable the “Sync My Closet” feature of the App, the App will access content from the inbox(es) of the provided email(s) to extract information related to purchases and returns of clothing and accessory items that the App will then independently store to your Virtual Closet on the App.
Note: You can restrict the App’s ability to access the contents of your email in this way at any time by deleting your email account(s) from the “Sync My Closet” feature of the App. If you choose to disable the “Sync My Closet” feature after enabling it, the App will immediately stop accessing your email in this way and no new items will be automatically added to your Virtual Closet. Any items previously added to your Virtual Closet via the “Sync My Closet” feature will remain stored in the Virtual Closet unless you manually delete them.
Usage Data refers to information about your device and the way you use it. Usage data includes but is not limited to:
o Your device’s IP address and other unique device identifiers and diagnostic data;
o Your browser type and browser version;
o Your mobile device type, mobile device ID, mobile device’s IP address, and your mobile browser type and mobile operating system;
o The identifying traits of items you combine to create outfits and the frequency with which you make same or similar combinations; and
o The pages of the App that you visit and how long you keep them open, the time and date of your visit.
Usage data is collected automatically while you are using the App and does not require any affirmative act on your part beyond consenting to this Privacy Policy and using the App. If at any point, you wish to revoke your consent to this Privacy Policy, you can email us at: [Email]. We will respond within [72] hours to either confirm that we have received your revocation and stopped collecting your usage data, or to request more information from you in order to do so.
Cookies are small files that are automatically placed on your device’s web browser to enable your browser to track the sites you visit, the sites you return to, the links and advertising popups that you open or follow, and other means of tracking your use of the internet. Some cookies, such as those necessary to authenticate users and prevent the fraudulent use of your account, are required in order for you to access and use the App. Other cookies, such as those that recall users login information or track users’ preferences to tailor parts of the experience to individual users, are not strictly required but may enhance your user experience.
Cookies are automatically collected, but you have the opportunity, at all times, to edit your cookie preferences to make your web browser more or less limiting in the types of cookies it collects. If you opt in your internet browser to use the “Do Not Track” feature, the App will not track your cookies across this app or any other app or site. The App may use Personal Data to provide the App’s Services, to tailor the user experience to individual preferences, to evaluate and maintain the App’s functions, to provide uninterrupted services in case of business reorganization, and to test new App features. A list of ways the App may use your Personal Data with further detail for each purpose follows.
● To provide the App’s Service, which relies on the App understanding your preferences, knowing what clothing and accessorizing items you possess and purchase throughout your ongoing use of the App; tracking the outfit combinations you create and how often you reuse such combinations; identifying patterns in the types of items you combine to produce outfits; and monitoring needs related to location, weather, and formality of various routine and special events.
● To evaluate and maintain quality of the App’s Service which requires the App to access usage information that may provide insight into the frequency, duration, and paths you take to navigate the various pages of the App as well as other types of information that might provide opportunity for the creators of the App to maintain and/or improve the App’s ability to perform the Services.
● To manage your account, which requires keeping your stored data exclusively available to your user profile.
● To contact you by email, telephone calls, SMS, push notification, or equivalent forms of electronic communication regarding updates, informative communications, new or changed functionalities, account access, and security updates when necessary.
● To provide you with tailored news, special offers and general information about other goods, services and events which are similar to those that you have already purchased or demonstrated interest (as measured by clicks, saves, visits to webpages, purchases, shares, and other means of measuring consumer interest online) unless you have opted not to receive such information.
● To manage your requests so the App’s pathways or technical assistants, as may be necessary, may troubleshoot and perform other actions to allow you access to your account and allow you to make changes to your preferences related to the App, including your choices about privacy and data handling as described herein.
● For business transfers such as merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all the App’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Data held by the App.
● For other purposes, such as data analysis, identifying usage trends, determining the effectiveness of the App’s promotional campaigns, testing new functionality or features, and evaluating and improving the Service, products, marketing and unique, as well as aggregate, user experience.
At Tried and Trend, we recognize that great style derives from your Personal Data with third parties and regulatory bodies only when necessary to provide the Services, tailor your user experience, comply with laws, and ensure continued service. A detailed explanation of the types of individuals or entities the App may share your data with follows.
● With Third Party Partners: the App may share your Personal Information with partners in the retail, fashion, social media influencer, and e-commerce sectors to curate outfit suggestions, purchase options, and content creators that align with your unique wardrobe wants, needs, and goals.
● With Service Providers: the App may share your Personal Information with Service Providers to monitor and analyze the use of our Service, to process your payments when necessary, and to contact you.
● For business transfers: the App may share or transfer your Personal Information in connection with any merger, sale of assets, or other allocation of ownership of the App to another company. The App will provide notice to you before your Personal Data is transferred or a new privacy policy is applied to your information.
● With Your consent: We may disclose your Personal Data for other purposes as may be necessary from time to time with your prior consent.
● Pursuant to law: the App may be required to disclose your Personal Data if required to do so by law or by subpoena or other legitimate requests by law enforcement and other regulatory authorities.
The App will store your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy and to comply with legal obligations (for example, if we are required to retain your data for a required period of time to comply with applicable laws), resolve disputes, and enforce legal agreements and policies.
The Company will also retain usage data for internal analysis purposes. Usage data is generally retained for a shorter period of time, except when necessary to i) strengthen the security or to improve the functionality of the App, or ii) we are legally obligated to retain this data for longer time periods.
Your Personal Data is processed in the state of Massachusetts, USA, and may be transferred to other locations within the United States as needed and depending on where the user and the parties involved in the processing are located. For users with permanent residences outside of the United States or during times when US-based users utilize the App from any location outside of the United States, Personal Data may be transferred and processed outside of the United States.
We take the security of your information very seriously and will take all steps reasonably necessary to ensure that your Personal Data is treated securely and in accordance with this Privacy Policy. We will ensure that no transfer of your Personal Data to an organization or a country occurs unless adequate controls are in place to secure said Data.
Please note that, while the App strives to protect users’ Personal Data, there is no way for us (or any entity) to guarantee its absolute security. We will comply with applicable laws to protect your information and notify you of any unintended disclosures of your Information that we become aware of.
